By accessing or using our platform, you acknowledge that you have read, understood, and agreed to be bound by these terms. These terms constitute a legally binding agreement between you and Brandmerce, LLC. If you do not agree with these terms in their entirety, you are prohibited from using our services.
2. Your Account
Registration:
To access certain features of Eduweby, you must register for an account. This requires providing certain personal information, which must be accurate and up-to-date.
Account Security: You are responsible for maintaining the confidentiality of your account credentials. Any unauthorized use of your account should be reported to Eduweby immediately. Brandmerce, LLC will not be liable for any losses caused by unauthorized use of your account.
Account Termination: Brandmerce, LLC reserves the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, not current, or incomplete.
3. Our Services
Description: Eduweby offers a comprehensive digital solution, including website design, enrollment management, and operational automation tailored for private schools and co-ops.
Service Changes: Brandmerce, LLC reserves the right to modify, suspend, or discontinue any part of our services at any time, with or without notice. We will not be liable to you or any third party should we exercise such rights.
Service Limitations: While we strive to provide uninterrupted service, we cannot guarantee this due to the need for periodic maintenance, unforeseen downtimes, or unexpected technical issues.
4. User Content
Rights: You retain all rights to the content you upload to Eduweby. However, by using our platform, you grant Brandmerce, LLC a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and display this content in connection with our services.
Content Responsibility: You are solely responsible for the content you upload and the consequences of posting or publishing it. Brandmerce, LLC does not endorse any user content and expressly disclaims any and all liability in connection with user content.
5. Our Intellectual Property
Ownership: All proprietary content, trademarks, service marks, brand names, logos, and intellectual property displayed on Eduweby are the property of Brandmerce, LLC and are protected by copyright, trademark laws, and other intellectual property rights.
Restrictions: You may not use, copy, reproduce, modify, or create derivative works from any content or trademarks from Eduweby without express written permission from Brandmerce, LLC.
6. Paid Services
Billing: Some features of Eduweby are offered as paid services. You’ll be billed in advance on a recurring basis as set by your subscription. All fees are non-refundable except where required by law.
Refunds: Unless otherwise stated, all fees are non-refundable. This includes any fees paid for premium services, even if you stop using them before the end of your billing cycle.
7. Cancellation and Termination
Policy: Customers can request a cancellation after making 3 consecutive payments and only after 90 days. Once your account is terminated, all your content will be irretrievably deleted after 30 days.
Effects of Termination: Upon termination, all rights and licenses granted to you will cease immediately, and you will no longer have access to your account.
8. Data Protection and Privacy
Commitment: Brandmerce, LLC is committed to protecting your personal data. Our Privacy Policy, which is incorporated by reference into these terms, outlines the types of information we collect, how we use it, and the choices you have regarding your data.
Data Storage: All user data is stored securely, and we employ measures to prevent unauthorized access.

Service Interruptions: Brandmerce, LLC is not responsible for any delays, service interruptions, or data loss resulting from factors outside our control.
12. Limitation of Liability
Liability Cap: Brandmerce, LLC, its affiliates, and its licensors will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, or data.
13. Governing Law
Jurisdiction: These terms are governed by the laws of the state of Florida. Any legal proceedings against Brandmerce, LLC must be commenced in Florida. Both parties consent to the jurisdiction of such courts.
14. Modifications to Terms
Updates: Brandmerce, LLC may update these terms periodically. Your continued use of Eduweby after such updates signifies your acceptance of the revised terms.
15. Third-Party Services
Integration: Eduweby may integrate with third-party services. While we aim to only integrate with reputable services, Brandmerce, LLC cannot be held responsible for their content or actions.
16. Miscellaneous
Severability: If any provision of these terms is deemed unenforceable, the remaining provisions will remain in effect. The failure of Brandmerce, LLC to exercise any right provided for herein will not be deemed a waiver of any further rights.
